General Terms and Conditions Florimo.nl
Article 1: Definitions
1.1. Florimo.nl: The webshop, owned by Timo Remmelzwaal, located at Meidoornstraat 21, 2225 SJ in Katwijk aan Zee, registered with the Chamber of Commerce under number 96769297.
1.2. Customer: The natural person or legal entity that enters into an agreement with Florimo.nl.
1.3. Agreement: The agreement between Florimo.nl and the customer with regard to the purchase and delivery of flowers.
1.4. Products: All flowers and related products offered by Florimo.nl.
Article 2: Applicability
2.1. These general terms and conditions apply to all offers, orders and agreements of Florimo.nl.
2.2. Deviations from these conditions are only valid if they have been agreed in writing.
Article 3: Offers and Agreements
3.1. All offers from Florimo.nl are without obligation, unless otherwise stated.
3.2. An agreement is concluded at the moment the customer places an order and Florimo.nl confirms this order.
3.3. Florimo.nl reserves the right to refuse orders without giving reasons.
Article 4: Prices and Payment
4.1. All prices include VAT, unless otherwise stated.
4.2. Payment must be made via the payment methods offered on the website.
4.3. Florimo.nl reserves the right to change prices.
Article 5: Delivery and Shipping
5.1. Delivery takes place within the Netherlands, Belgium and Germany via POSTNL.
5.2. Florimo.nl strives to deliver orders as quickly as possible, but cannot guarantee a specific delivery date.
5.3. The customer is responsible for providing a correct delivery address.
5.4. In the absence of the customer at the delivery address, POSTNL will, if possible, deliver the package to the neighbours, or the package will be taken to a post office. A note will then be left in the letterbox.
Article 6: Quality and Complaints
6.1. Florimo.nl guarantees the freshness and quality of the delivered flowers.
6.2. Complaints about the quality of the flowers must be reported by email within 24 hours of receipt.
6.3. In the event of justified complaints, Florimo.nl will provide an appropriate solution, such as replacement or refund.
Article 7: Right of withdrawal
7.1. Fresh flowers are excluded from the right of withdrawal, given their perishable nature.
7.2. Other products, if applicable, can be returned within 14 days of receipt, provided they are unused and in their original packaging.
Article 8: Liability
8.1. Florimo.nl is not liable for damage caused by incorrect use of the products.
8.2. Florimo.nl's liability is limited to the invoice amount of the order in question.
Article 9: Force Majeure
9.1. In the event of force majeure, such as strikes, transport problems or natural disasters, Florimo.nl is not liable for failure to comply with the agreement.
Article 10: Intellectual Property
10.1. All intellectual property rights relating to the website and products of Florimo.nl are vested in Florimo.nl.
Article 11: Applicable Law and Disputes
11.1. Dutch law applies to all agreements.
11.2. Disputes will be submitted to the competent court in the place of business of Florimo.nl.
Article 12: Amendments
12.1. Florimo.nl reserves the right to amend these general terms and conditions. Amendments will be published on the website in a timely manner.
